a. User restrictions and guidelines-

You expressly acknowledge and agree that the user generated content provides a means of public and not private communication.

You understand and agree that it is a condition of your participation in any user-generated content that you do not to do any of the following things.

  1. Restrict or inhibit any other user from using or enjoying the forum. And upload or post content that may disrupt the normal flow of dialog or otherwise impact negatively on another users ability to engage in the forum.
  2. Upload or post any material which is, or could be reasonably expected to be, unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, invasive of another person’s privacy, racially hateful or otherwise objectionable.
  3. Upload or post any material which is, or could be reasonably expected to, encourage conduct that would constitute a criminal offence.
  4. Upload or post any material which may harm minors in any way.
  5. Upload or post any material which would impersonate another person or misrepresent your affiliation with another person or identity. Or material that you know (or reasonable ought to know) to be false or misleading in some way
  6. Upload or post material which is not your original work, or which violates or infringes upon the rights of another, such as material that is protected by copyright, trademark or other intellectual property rights.
  7. Upload or post any material which you do not have a right to make public, such as, but not limited to, confidential information, or material obtained under a fiduciary relationship.
  8. Upload or post any material which contains viruses or other harmful components.
  9. Delete any other author’s attributions or any other material that is uploaded

You understand that software and the service itself may contain imbedded security components. You understand and agree that you are not permitted to override or circumvent any of those usage rules embedded into the Service.

b. User License to Universal Magazines-

Universal Magazines does not claim ownership over any content posted by users on the service.

However, by placing any content or other material on the Universal Magazines service (including information, text, images, photos, audio or video), you agree to grant to Universal Magazines a perpetual, worldwide, royalty free, non-exclusive, irrecoverable license to do any of the following:

  1. Exploit all proprietary rights in the content, including to use, distribute, reproduce, sublicense, modify, adapt, publically perform and publically display such content, and
  2. To sublicense to any third parties the unrestricted right to exercise any of the above rights granted.

c. Contributions to Universal Magazines-

If you choose to supply contributions to Universal Magazines by way of suggestions and feedback and other submissions of ideas, you agree that:

(a)  Those contributions will not attract confidentiality or proprietary information,

(b)  Universal Magazines is not under any obligation of confidentiality, whether express or implied with respect to these contributions,

(c)  Universal Magazines will be entitled to disclose such contributions for nay purpose and in any way,

(d)  You are not entitled to any compensation or reimbursement of any kind form Universal Magazines under any circumstances.

d. Rights of Universal Magazines-

You acknowledge and agree that Universal Magazines has the following rights in regards to user generated content and member conduct:

  1. The right,from time to time, to pre-screen content, monitor users, and edit, refuse or remove content posted on the service by users, in whole or in part. That right is not an obligation and will be exercised at Universal Magazines discretion. Therefore Universal Magazines is not responsible for any user generated content.
  2. The right to remove any content that violates these terms or that can reasonably be considered objectionable
  3. You acknowledge and consent to Universal Magazines having the right to access, preserve and disclose users account information and content if required to do so by law or in a good faith belief that such disclosure is reasonably necessary to (a) comply with legal proceedings, (b) enforce these terms, (c) respond to claims that any content violates the rights of third parties, (d) protect the rights, property or personal safety of Universal Magazines, its users and the public.

e. Offensive material-

You understand that at times you may be exposed to content that is offensive, indecent or otherwise objectionable. Universal Magazines is in no way accepts any liability for that content and for any loss or damage incurred by you as a result of exposure that that content.

Universal Magazines services contain advertisements and hyperlinks to websites operated by third parties. You agree that you link to any such website at your own risk. Universal Magazines exercises no control over third party websites and is not responsible for the content or reliance of the content found on those websites.

All third party advertisements and links are paid for by that party and displayed as a convenience to you. The display of such advertisements and links on Universal Magazines websites does not imply endorsement of the linked website by Universal Magazines.

All products listed by third parties on Universal Magazines services for purchase are the responsibility of the relevant retailer and are accurate at the time the retailer notifies Universal Magazines. Universal Magazines is not liable for any price discrepancies.

8. Indemnity for Advertising:

You acknowledge and agree that the comments or opinions contained in the user generated content are not the comments or opinions of Universal Magazines.

You agree to fully indemnify and hold harmless Universal Magazines and its related entities against liabilities, claims, loss, consequential loss, and damage incurred

  1. Due to your reliance on any user generated content.
  2. As a result of material you post or as a result of any breech by you of these terms and conditions.

9. Disclaimer of Warranties:

You expressly understand and agree that:

  1. All services are provided ‘as is’ and free from any express or implied warranties of any kind, particularly, but not limited to, those relating to its merchantability and fitness for a particular purposes, stated or otherwise.
  2. You are responsible for obtaining access to the services and for payment of any fees associated with gaining that access.
  3. Universal does not warrant that your use of the services will be uninterrupted, error-free, or that the server that stores and transmits the content to you will be secure and free from viruses or other harmful components. Any material downloaded or otherwise obtained through the services is accessed at your own discretion. You will be solely responsible for any damage to your computer system or any other loss that may flow form use of the services.
  4. Universal Magazines accepts no responsibility for the content of its services, in relation to its correctness, accuracy, timeliness, reliability etc.
  5. Universal Magazines accepts no responsibility for the quality of the products or information or other material sourced or purchased by you through the services provide by Universal Magazines.
  6. Universal Magazines therefore accepts no responsibility if you act in reliance on any information found on the services or for any other consequences that flow from your access to its services (including any related or linked website).
  7. The Universal Magazines service may provide links to other external websites or resources. 11. Modification/Termination of Services by Universal Magazines:

Universal Magazines reserves the right to modify the content found on its services at any time, or to discontinue, temporarily or permanently, the service or any part of the service with or without notice to you and for any reason. You agree that Universal Magazines shall not be liable to you or any third party for any of the above modifications or terminations of the service.

Universal Magazines enlists the services of overseas computer networks. Please read these specific terms for use of the home related website. They apply in addition to the general terms governing the use of all Universal Magazines websites.

The information on the Grand Designs Australia Magazine website comes in the form of editorial articles, expert articles and discussion board threads on home topics. That information is generic in nature and is not to be used by any individual in place of proper assessment and action by a professional.

a. Refund & Returns Policy:

If you pre-purchase magazines by subscription or mail order from our websites, and for some reason are unhappy with the products or do not receive the correct products, we are happy t exchange or refund your purchase at any time.

If for some reasons the subscription or mail order items ordered are not available, you shall be refunded.

If you pre-purchase advertising from our websites, and for some reason are not happy with the service provided, refunds are not available.

b. Delivery Instructions:

If you pre-purchase magazines by subscription, delivery shall be made within 7 days of publication according to the publishing schedule.

If you pre-purchase mail order products from our websites, deliver shall be made within 60 days of receipt of your order.

If you pre-purchase advertising from one of our websites, the ad shall be made live within 30 days of receipt of material.

17. General Terms:

a. Severability:

If any part or parts of this agreement is found to be invalid or unenforceable by a court of law, that provision must be read down. In that same event, such invalidity shall not affect the enforceability of the remainder of this agreement.

b. Jurisdiction:

This Terms of Service agreement shall be governed by the laws of New South Wales, Australia and you agree to unconditionally submit to the jurisdiction of the courts of New South Wales.

c. General Indemnity:

You agree to indemnify and hold Universal Magazines and its affiliates, employees, agents and licensors harmless from any claim or demand, including legal fees, made by any third party due to an action arising out of content that you submit, post, transmit or otherwise make available through the services provided by Universal Magazines, or your use of the same services, or your violation of these terms of Service, or your violation of any other rights of another.
